KingConnect Terms and Conditions

Version 1.0 – May 2025

These terms and conditions apply to the use of the KingConnect application, developed and provided by: EnergyKing NV, Mechelsesteenweg 676, 3020 Herent, Belgium (BE 0806 516 101).

By using the app or activating a subscription, you agree to these Terms and Conditions.

 

1. Scope

These terms and conditions apply to:

  • Using the KingConnect app on a smartphone or the web
  • Optional access to data services via a paid connection to your energy system (through a smart gateway)

 

2. Terms of Use

  • You are at least 18 years old or have the consent of a legal representative.
  • You may use the app only for personal purposes, in accordance with these terms and conditions.
  • You are responsible for ensuring the accuracy of your information.

 

3. Description of the Service

KingConnect provides users with insights into their energy systems, including:

  • Visualization of power flows (PV, battery, grid, consumption)
  • Smart control of compatible devices
  • Notifications regarding usage, capacity, or technical alerts
  • Access to Support and Information (FAQ, Contact)

Certain features require an active connection to a physical EnergyKing gateway and a valid subscription.

 

4. Subscriptions and Payments

  • A paid subscription is required to access certain real-time energy services (such as power data, control, or history).
  • The payment covers the connection to your system's physical data stream, not the use of the app itself.
  • Payments are processed through Stripe and can be initiated within the app via a secure external flow. All payments are processed outside of the Apple and Google App Stores.
  • EnergyKing does not process or store any card information.
  • The subscription is automatically renewed each month unless canceled through the provided payment portal.
  • The app also includes free features, such as access to FAQs, contact information, general product information, system status, and simple charts.

 

5. Term and Termination

  • You can cancel your subscription at any time through the online payment portal (Stripe).
  • EnergyKing reserves the right to temporarily or permanently restrict access in the event of misuse or violations.

 

6. Installation and Requirements

  • For proper operation, a compatible smart gateway is required, properly connected to your system.
  • EnergyKing is not responsible for malfunctions caused by improper installation or incompatible third-party devices.
  • You are responsible for your own network settings (e.g., P1 port, Wi-Fi, or LAN).

 

7. Intellectual Property

All rights to software, dashboards, algorithms, data visualizations, and text belong to EnergyKing or its technology partners.
You are granted a non-exclusive, personal right of use.

 

8. Liability

  • EnergyKing is not liable for temporary unavailability of the service
  • EnergyKing is not liable for incorrect or incomplete data from external systems (such as PV inverters or gateways)
  • EnergyKing is not liable for malfunctions caused by third-party hardware, faulty networks, or user configuration
  • EnergyKing shall in no event be liable for any indirect damages, including loss of data, profits, revenue, use, or business opportunities.
  • EnergyKing’s total liability—regardless of the cause or legal basis—is limited to the lesser of: (a) €100 or (b) the total amount of subscription fees you paid in the six months prior to the claim.
  • EnergyKing does not guarantee any financial returns (such as imbalance fees, third-party payments, or grid fees), and is not liable for lost profits, incorrect market responses, missed activations, or losses resulting from smart control or market-based logic.
  • EnergyKing is not liable for damage to devices or systems if such damage is caused by manual settings or changes made by the user.
  • EnergyKing shall not be liable for any failure to perform or delay in performing its obligations if such failure or delay is due to force majeure.

 

9. Personal Data

10. Changes

EnergyKing reserves the right to change these terms and conditions. We will notify you via email or through the app. The revised terms and conditions take effect upon publication.

 

11. Governing Law and Jurisdiction

Belgian law applies. Any disputes shall be subject to the exclusive jurisdiction of the Dutch-language courts of Leuven.
